There is a court in Luxembourg. And we had no doubts that the Court of Justice of the European Union would have proved Italy and Greece right and legitimised the decisions of the European Parliament and of the Council on the outplacement of migrants. The appeal presented by Slovakia and Hungary, with the public defence of the Polish Government, was “fully” rejected demonstrating that the policy of hosting must be shared in a spirit of solidarity.
The judgment strengthens the European response and lays the foundations to start infringement procedures against the countries which draw back. It is not everything, but it is something. Significant is the fact that many countries participated in the legal action in support of the positions of the European Council: Germany, France, Italy, Greece, Belgium, Sweden and Luxembourg have defended the policy of “relocation” which for the Court “contributes in a proportionate manner to ensure that Greece and Italy can cope with the consequences of the 2015 migration crisis “. Without prejudice to the principle, and having reaffirmed the legal basis of the measure, now we need to proceed quickly to the distribution of the quotas allocated to each country.
In short, there is a court in Luxembourg with good peace of xenophobic and populist countries. And this Court reaffirmed that asking for more Europe is possible with the instruments at our disposal. Certainly, the drama of immigration will not be resolved by this judgment, but it is surely an anchor to respond with solidarity and humanity to the request of poor people in search of a better life.
The migratory crisis continues to be a dramatic emergency but after years of inaction finally Europe begins to move. Now the gaze must go further, where the life of migrants is in danger and where Europe and the United Nations cannot turn their backs.
